Important: These Terms are intended to operate together with the applicable product/service page, order confirmation, refund/cancellation policy, privacy notice and any specific terms presented to you at the time of purchase. Where a product-specific term expressly applies to a particular Service, that term will govern to the extent of the inconsistency.
01Acceptance and scope
1.1 These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you” or “your”) and Mathsarc Education LLP (“Mathsarc”, “we”, “us” or “our”) concerning your access to and use of www.mathsarc.com and related websites, applications, accounts, educational products, tutoring, subscriptions, digital content and other services (“Platform” or “Services”).
1.2 By accessing the Platform, creating an account, placing an order, booking a session, subscribing to a Service or otherwise using the Services, you acknowledge that you have read, understood and agreed to these Terms and the policies expressly incorporated into them.
1.3 If you do not agree to these Terms, you must not access or use the relevant Service.
02Eligibility, minors and parental responsibility
2.1 You must provide information that is accurate, current, complete and not misleading. You must have the legal capacity required to enter into the applicable transaction.
2.2 Our Services may be used by students below 18 years of age. Where a user is a child under applicable Indian data-protection law, any processing of the child's personal data will be undertaken subject to the legally required parental or lawful guardian consent and safeguards.
2.3 A parent, guardian, school or other lawful representative may create or manage an account or purchase Services on behalf of a minor. Where appropriate, references to “you” include the relevant parent or lawful guardian acting on the minor's behalf.
2.4 You must not create an account by impersonating another person or by using another person's identity, contact information or credentials without lawful authority.
03Registration, authentication and account security
3.1 Registration may require information such as your name, email address, mobile number and other information reasonably necessary to provide the Services. We may use mobile OTP, email verification or other authentication mechanisms.
3.2 You are responsible for maintaining the confidentiality of your login credentials and for activities carried out through your account, except to the extent caused by our failure to comply with applicable law or our own security obligations.
3.3 You must promptly notify us if you reasonably suspect unauthorised access, compromise of credentials or misuse of your account.
3.4 We may require additional verification or temporarily restrict access where reasonably necessary to protect the Platform, users, transactions or against fraud, abuse or security threats.
04Educational products and Services
4.1 Mathsarc may offer, among other Services, live and recorded educational classes, subscriptions, examination-preparation programmes, tutoring, home tuition, online tutoring, assessments, digital resources and related services.
4.2 Service descriptions, syllabus, faculty, schedule, duration, batch size, access period, deliverables and other material terms will be stated on the relevant product or booking page and/or order confirmation.
4.3 We may make reasonable operational changes to faculty, schedule, delivery method, batch composition or platform features where necessary for academic, technical, safety or operational reasons. Where a material change substantially affects a paid Service, we will provide an appropriate remedy in accordance with the applicable policy and law.
4.4 Academic outcomes, examination ranks, admissions, marks or other results are not guaranteed unless an express written contractual commitment states otherwise. Testimonials and historical results are not guarantees of future outcomes.
05Prices, payments, GST and transaction records
5.1 Prices and applicable charges are displayed at the point of purchase. Unless expressly stated otherwise, the amount payable will include applicable taxes and charges that are required to be collected from you and are shown at checkout.
5.2 You authorise the applicable payment processor to process the transaction using the payment method selected by you. We do not store complete payment-card credentials on our own systems where the transaction is processed by a third-party payment provider.
5.3 An order is subject to successful payment and any additional confirmation expressly required for that Service. We may decline, cancel or place a transaction on hold where reasonably necessary to address suspected fraud, payment failure, pricing or technical error, duplicate transaction or other legitimate compliance/security concern, subject to applicable law.
5.4 You must not initiate a fraudulent or knowingly unjustified chargeback. Nothing in these Terms prevents you from exercising a genuine statutory or contractual right to dispute an unauthorised or incorrectly processed transaction.
06Cancellation, refunds and service-specific policies
6.1 Cancellation, rescheduling and refund rights vary according to the nature of the Service, the stage of performance, the applicable product policy and applicable law.
6.2 The cancellation/refund terms displayed on the relevant product, subscription, booking or checkout page form part of the contract for that transaction. Where a Service has been fully or substantially delivered, access has commenced, a live session has been conducted, or digital content has been made available, any refund will be determined by the applicable policy and law.
6.3 Nothing in these Terms excludes or restricts any consumer right, refund right or remedy that cannot lawfully be excluded or restricted under applicable Indian law.
6.4 Where a refund is approved, it will ordinarily be processed through the original payment route or another lawful method agreed with you, subject to payment-provider processing timelines and applicable law.
Important: There is no blanket contractual promise of a 14-day cancellation period in these Terms. Any cooling-off, cancellation, refund or withdrawal right will depend on the applicable law and the particular Service/transaction. This avoids treating a foreign distance-selling concept as a universal Indian statutory right.
07Intellectual property and permitted use
7.1 Unless expressly stated otherwise, the Platform, its software, design, branding, logos, course structure, videos, notes, question banks, assessments, text, graphics, audio, compilations and other materials are owned by or lawfully licensed to Mathsarc and are protected by applicable intellectual-property laws.
7.2 Subject to these Terms and payment of applicable fees, Mathsarc grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the relevant educational content solely for your personal educational use during the applicable access period.
7.3 You must not, without prior written permission or a legal right to do so, reproduce, record, download, scrape, redistribute, publish, sell, sublicense, commercially exploit, reverse engineer, circumvent access controls or make available to others any protected content.
7.4 Nothing in these Terms transfers ownership of Mathsarc's intellectual property to you.
08Personal data, privacy and communications
8.1 Mathsarc processes personal data in accordance with applicable Indian data-protection law, including the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025, to the extent applicable to the relevant processing and provision of the Services.
8.2 The purposes, categories of personal data, lawful basis/consent mechanism where applicable, retention, sharing, security measures and rights available to Data Principals are described in our Privacy Policy and applicable notices.
8.3 Where consent is the applicable basis for processing, consent will be obtained and managed in accordance with applicable law. Where another lawful ground applies, processing may occur on that basis.
8.4 You may have rights available under applicable data-protection law, including rights relating to access to information about processing, correction, updating, erasure where applicable, grievance redressal and withdrawal of consent where consent is the applicable basis. Requests will be handled subject to identity verification, legal exceptions and applicable retention obligations.
8.5 We may send transactional, service, security and account communications necessary for the Services. Promotional communications will be handled in accordance with applicable law and the choices/mechanisms made available to you.
Children: Where applicable, Mathsarc will apply the additional safeguards required for processing a child's personal data, including obtaining verifiable parental or lawful guardian consent as required by law.
09Acceptable use and prohibited conduct
9.1 You must use the Platform lawfully and responsibly. You must not:
- use the Platform for unlawful, fraudulent, deceptive or abusive purposes;
- attempt unauthorised access, interfere with security controls or disrupt Platform availability;
- upload or transmit malware, malicious code or material intended to compromise systems;
- scrape, harvest or systematically extract data without our prior written authorisation or a lawful basis;
- infringe intellectual-property, privacy, confidentiality or other legal rights of another person;
- share account credentials or paid access in a manner that defeats the applicable access restrictions;
- record, reproduce or redistribute live/recorded classes or protected educational material without permission or lawful authority; or
- use the Platform to harass, threaten, discriminate against, defame or materially harm another person.
9.2 We may take proportionate action, including restriction, suspension or termination of access, where reasonably necessary because of a material breach, fraud, security risk or unlawful activity, subject to applicable law and any required notice or remedy.
10Tutors, bookings and marketplace Services
10.1 Where Mathsarc facilitates tutor discovery, booking or online tutoring, the applicable booking page will identify the material commercial terms, including teaching mode, duration, fees, applicable platform/booking charges, schedule and other relevant conditions.
10.2 Tutors may be independent service providers or other participating professionals, depending on the Service structure. Where a Service involves a marketplace or facilitation arrangement, Mathsarc's role will be described on the relevant Service page and transaction documents.
10.3 Tutor profiles, ratings, qualifications, experience and other information are provided for informational and selection purposes. Users should consider the information available before booking.
10.4 Session termination, minimum billable duration, refund of unused booked time, tutor earnings and platform fees will be governed by the specific booking terms presented at the time of booking.
11Availability, warranties and force majeure
11.1 We use reasonable efforts to keep the Platform and Services available, but uninterrupted or error-free availability cannot be guaranteed.
11.2 Except where expressly provided or required by law, information and Services are provided subject to applicable terms, and we do not warrant that every item of content will always be complete, current, uninterrupted or free from technical errors.
11.3 We are not responsible for delay or non-performance caused by events beyond our reasonable control, including natural disasters, epidemic/pandemic events, internet or telecommunications failures, governmental action, infrastructure failures, payment-network outages, cyber incidents not caused by our breach of applicable security obligations, or other force-majeure events.
12Limitation of liability
12.1 Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.
12.2 Subject to the preceding paragraph, Mathsarc will not be liable for indirect, incidental, special or consequential loss to the extent such loss may lawfully be excluded.
12.3 Subject to applicable law, our aggregate contractual liability arising from a particular paid Service will not exceed the amount actually paid by you for that Service, except where a different limit is required by law or expressly agreed in writing.
12.4 Nothing in this Section limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded.
13Indemnity
13.1 To the extent permitted by applicable law, you agree to indemnify and hold harmless Mathsarc, its designated personnel and lawful service partners against third-party claims, losses, liabilities and reasonable costs arising directly from your unlawful use of the Platform, material breach of these Terms, fraud or infringement of another person's rights.
13.2 This clause does not require you to indemnify Mathsarc for losses caused by Mathsarc's own fraud, wilful misconduct or liability that cannot lawfully be shifted to you.
14Suspension and termination
14.1 We may suspend or terminate an account or Service where reasonably necessary because of material breach, fraudulent activity, unlawful conduct, payment abuse, security risk, misuse of educational content, or where required by law.
14.2 Where practicable and legally permissible, we will provide notice and an opportunity to remedy a breach before permanent termination. Immediate action may be taken where necessary to protect users, the Platform, third parties or legal compliance.
14.3 Termination does not affect rights or obligations accrued before termination, including payment obligations, intellectual-property protections, confidentiality, dispute-resolution provisions and other clauses intended to survive termination.
15Third-party services and links
15.1 The Platform may contain links to third-party websites or use third-party services such as payment processors, communications providers, hosting providers or other technology providers.
15.2 Third-party services are subject to their own terms and privacy practices. Mathsarc does not assume responsibility for a third party's independent acts or omissions except to the extent responsibility is imposed on Mathsarc by applicable law or contract.
16Advertising, testimonials and representations
16.1 Product descriptions, offers, testimonials, rankings, historical results and promotional material must not be interpreted as a guarantee of a particular academic, financial or admissions outcome unless expressly stated as a contractual commitment.
16.2 We aim to present material information accurately and may correct typographical, pricing, scheduling or technical errors. Nothing in these Terms authorises misleading advertising or unfair trade practices.
16.3 Any sponsored, affiliate, partner or third-party relationship that requires disclosure under applicable law will be disclosed in the manner required by law.
17Changes to these Terms
17.1 We may update these Terms from time to time to reflect changes in Services, technology, law, regulatory requirements or business operations.
17.2 The updated version will be published on the Platform with an updated effective/revision date. Where applicable law requires notice, consent or another form of communication for a material change, we will follow the legally required process.
17.3 Continued use of the Platform after an effective update constitutes acceptance only to the extent such acceptance is legally effective.
18Customer support, complaints and grievance redressal
18.1 We encourage you to first contact us so that we can investigate and resolve a complaint efficiently.
18.2 For a complaint relating to a Service, transaction, account, content, privacy matter or other Platform issue, please provide sufficient details to identify the transaction or issue. We may request reasonable verification of identity.
18.3 Where a specific grievance mechanism or Grievance Officer is required under applicable law for the relevant Service or Platform activity, the applicable details will be made available in the relevant policy or notice.
19Governing law and jurisdiction
19.1 These Terms and the relationship between you and Mathsarc are governed by the laws of India, subject to any mandatory consumer-protection or other statutory rights applicable to you.
19.2 Subject to applicable law, disputes arising from these Terms or the Services shall be subject to the jurisdiction of the competent courts at Pune, Maharashtra.
19.3 Nothing in this clause prevents a consumer from exercising a statutory right to approach a competent consumer forum, commission, authority or other legal mechanism having jurisdiction under applicable law.
20Severability, waiver and entire agreement
20.1 If any provision of these Terms is held invalid, unlawful or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
20.2 A failure or delay by either party to exercise a right does not constitute a waiver of that right.
20.3 These Terms, together with the applicable Privacy Policy, product/service terms, order confirmation and other expressly incorporated policies, constitute the agreement governing the relevant use or transaction, subject to applicable law.
